Need Advice on Counterfeit Without a Test Buy Suspension

Hello everyone,

I need advice from experienced sellers or moderators regarding a "Counterfeit Without a Test Buy" suspension under Section 3.

Amazon flagged our "Milwaukee" ASINs as inauthentic and requested invoices. First seller submitting purchase receipts from Club Cadet — third-party online platform — but Amazon keeps rejecting them. Then second time provide Invoices but not entirely sure if the submitted invoices is actual invoice or not.

However, as far as I know, third-party platforms usually don't issue proper invoices — they typically provide order receipts instead.

What will be the best solution to get back the account:

- Contact the Milwaukee brand directly for authorization THEN Get a Letter of Authorization (LOA) and request to be added to their whitelist THEN Place a bulk purchase directly from the brand and submit fresh invoices with a detailed appeal....

I have been away on an actual vacation for more than two weeks and looked at NOTHING on Amazon except one buyer message so this reply is late.

All the others are pretty spot on.

In over 15 years here I can't remember any recent (5 years or more) cases of Amazon accepting an 'after the fact' LOA for anything.

As noted by several long time sellers, Amazon expects full knowledge AND compliance BEFORE sellers ever begin selling here.

Sadly, Amazon GREED means that they refuse to institute a simple TEST on the rules (and LAWS) about selling here before anyone should be allowed to even apply for a selling account.

If this seller sold Milwaukee tools as NEW they broke many policies and likely some laws since they sold as new without the warranties that Milwaukee tools have when sold properly.

As to recovering any money, it is extremely unlikely since the have NO proof of authenticity and no chain of custody. As a result Amazon is justified (and likely legally required) in holding the money as a result of selling 'counterfeit' items.

If you are going to pretend to be a 'consultant' you need to KNOW these things before you offer any advice or services. OR have a really good attorney to protect your assets when you get sued.

I don't think that will help you as Amazon will want to see proper invoices for everything dated before your suspension. Getting authorization after the fact doesn't address what you've already listed & sold.

well, then as you know, seller violated sourcing guidelines. There is also no proof the products are authentic and brand backed.

That means funds will likely be confiscated and not paid out. As everyone is told in one of the notifications, 90 days after the last sale you can request to be paid. At this time they will look at invoices and receipts again and likely decide that the seller will not be paid. At that point, there is arbitration.

Funds disbursement eligibility policy

If we deactivate your account under Section 3 of the Business Solutions Agreement and determine that your actions may result in risks to Amazon or third parties, then we may withhold any funds that may be in your account. These funds may be used to cover liability from your conduct and offset amounts that you owe, such as product returns or refunds, A-to-z claims from customers, inventory removal costs, outstanding fees, or monetary and non-monetary damages inflicted on Amazon.

Amazon wants sellers who do things right BEFORE they get caught. It's been made very clear that for any sort of IP violation, the ONLY recourse is to submit the required paperwork. No PoA, no apologies, no promises to follow the rules in the future; you MUST have the required documentation.

I seriously doubt that there is any way forward for this person.

Funds disbursement eligibility policy

If we deactivate your account under Section 3 of the Business Solutions Agreement and determine that your actions may result in risks to Amazon or third parties, then we may withhold any funds that may be in your account. These funds may be used to cover liability from your conduct and offset amounts that you owe, such as product returns or refunds, A-to-z claims from customers, inventory removal costs, outstanding fees, or monetary and non-monetary damages inflicted on Amazon.

You may appeal your account deactivation by following the instructions provided to you in the notice of account deactivation or in Seller Central. If your account is reinstated as a result of the appeal, funds will be released and disbursed according to your disbursement schedule.

Even if your appeal is not decided in your favor, or you choose not to appeal the deactivation, you can separately appeal to seek any withheld funds by contacting disbursement-appeals@amazon.com at any point after 60 days from the date when your account was deactivated. We will release any remaining funds (less any amounts used to offset amounts you owe us) after evaluating your account for deceptive, fraudulent, or other illegal activity and confirming your identity.

During this process, we may request that you provide additional information or documentation regarding your identity, financial instruments, or supply chain. This additional information is critical to our anti-fraud controls. Additionally, we may validate any information that you provide with third party services or government agencies.

If we find that you have engaged in deceptive, fraudulent, harmful, or illegal activity, have abused our systems, or repeatedly violated our policies, or if we cannot confirm your identity, we may in our sole discretion permanently withhold any payments to you.

Amazon wants sellers who do things right BEFORE they get caught. It's been made very clear that for any sort of IP violation, the ONLY recourse is to submit the required paperwork. No PoA, no apologies, no promises to follow the rules in the future; you MUST have the required documentation.

I seriously doubt that there is any way forward for this person.

I have been away on an actual vacation for more than two weeks and looked at NOTHING on Amazon except one buyer message so this reply is late.

All the others are pretty spot on.

In over 15 years here I can't remember any recent (5 years or more) cases of Amazon accepting an 'after the fact' LOA for anything.

As noted by several long time sellers, Amazon expects full knowledge AND compliance BEFORE sellers ever begin selling here.

Sadly, Amazon GREED means that they refuse to institute a simple TEST on the rules (and LAWS) about selling here before anyone should be allowed to even apply for a selling account.

If this seller sold Milwaukee tools as NEW they broke many policies and likely some laws since they sold as new without the warranties that Milwaukee tools have when sold properly.

As to recovering any money, it is extremely unlikely since the have NO proof of authenticity and no chain of custody. As a result Amazon is justified (and likely legally required) in holding the money as a result of selling 'counterfeit' items.

If you are going to pretend to be a 'consultant' you need to KNOW these things before you offer any advice or services. OR have a really good attorney to protect your assets when you get sued.
